Barrington Group Australia Pty Ltd (“Barringtons”, “Us” or “We”) is committed to protecting your privacy and developing technology that gives you the most powerful and safe online experience. 

This policy explains how and why we collect, use, hold and disclose your personal information in accordance with the Australian Privacy Principles (APPs). 

This Privacy Policy applies to the “Barringtons” Website, Application, and Cloud platform (collectively the “Site”) and governs data collection and usage. By using the “Barringtons” Site, which may include the Smartek site, you consent to the data practices described in this privacy policy (“Privacy Policy”). 

THIS PRIVACY POLICY WILL BE EFFECTIVE EARLIER OF (1) YOU START USING OUR SITE(S), OR (2) YOU CLICK “I ACCEPT” OR A SIMILAR BUTTON OR CHECK BOX PRESENTED TO YOU AS PART OF THE SIGN-UP PROCESS. 

1. What is personal information? 

Personal information is any information or an opinion about an identified individual or an individual who can be reasonably identified from the information or opinion. Information or an opinion may be personal information regardless of whether it is true. 

2. Collection of your Personal Information 

We collect information about you and your interactions with us, for example, when you utilise the contact us functionality on our website, call us, visit us, speak with one of our staff, interact with our chatbot or otherwise visit our website. The information we collect from you may include your identity and contact details, your history of your interactions with us and details of enquiries or complaints you make. 

We collect personally identifiable information, such as your email address, name, home or work address or telephone number. “Barringtons” also collects anonymous demographic information, which is not unique to you, such as your ZIP code, age, gender, preferences, interests, and favourites. 

There is also information about your computer hardware and software that is automatically collected by “Barringtons”. This information can include: your IP address, browser type, domain names, access times and referring website addresses. This information is used by “Barringtons” for the operation of the Service, to perform “Barringtons” obligations pursuant to the Agreement between “Barringtons” and You, to maintain quality of the service, and to provide general statistics regarding use of the “Barringtons” Site. 

Please keep in mind that if you directly disclose personally identifiable information or personally sensitive data through “Barringtons” public message boards (if any), this information may be collected and used by others. Note: “Barringtons” does not read any of your private online communications.

“Barringtons” encourages you to review the Privacy Policy of Sites you choose to link to from “Barringtons” so that you can understand how those Sites collect, use and share your information. “Barringtons” is not responsible for the Privacy Policy or other content on Sites outside of the “Barringtons” and “Barringtons” family of Sites.

“Barringtons” keeps track of the Sites and pages our customers visit within “Barringtons”, in order to determine what “Barringtons” services are the most popular. This data is used to deliver customized content and advertising within “Barringtons” to customers whose behaviour indicates that they are interested in a particular subject area. 

“Barringtons” Sites will disclose your personal information, without notice, only if required to do so by law or in the good faith belief that such action is necessary to: (a) conform to the edicts of the law or comply with legal process served on “Barringtons” or the Site; (b) protect and defend the rights or property of “Barringtons”; and, (c) act under exigent circumstances to protect the personal safety of users of “Barringtons”, or the public.

The “Barringtons” Site use “cookies” to help you personalise your online experience. “Barringtons” will occasionally update this Privacy Policy to reflect company and customer feedback. “Barringtons” encourages you to periodically review this Privacy Policy to be kept informed of how “Barringtons” is protecting your information.

You may access or request correction of the personal information that we hold about you by contacting us. Our contact details are set out below. There are some circumstances in which we are not required to give you access to your personal information. 

There is no charge for requesting access to your personal information, but we may require you to meet our reasonable costs in providing you with access (such as photocopying costs or costs for time spent on collating large amounts of material). 

We will respond to your requests to access or correct personal information in a reasonable time and will take all reasonable steps to ensure that the personal information we hold about you remains accurate and up to date. 

8. Processing 

“Barringtons” processes certain Personal Information or Personal Data on behalf of its Customers. Any such processing of your Personal Information or Personal Data by “Barringtons” shall be governed by the Data Protection Agreement between “Barringtons” and the Customer, a copy of which can be found on https://smartek.com/data-processing-addendum/. 

9. Consent 

If you do not agree with any of the provisions of this Privacy Policy, you should immediately stop using our Site(s) and notify “Barringtons.” By using “Barringtons” Site(s), you hereby consent to our collection, storage, use, and processing of your personal information including, but not limited to, your IP address, browser type, domain names, access times and referring website addresses, personally identifiable information and sensitive personal information relating to COVID vaccinations etc.

We will consider your complaint and determine whether it requires further investigation. We will notify you of the outcome of this investigation and any subsequent internal investigation.
